”Win Polish Volleyball League” TERMS AND CONDITIONS

I. General Provisions
1. The contest entitled “Win Polish Volleyball League” (hereinafter “the Contest”) is organised by Gameweek Sp. z o. o. z siedzibą w Warszawie (00-863), przy ul. Grzybowskiej 30/1121, wpisaną do rejestru przedsiębiorców Krajowego Rejestru Sądowego, prowadzonego przez Sąd Rejonowy dla m. st. Warszawy w Warszawie, XII Wydział Gospodarczy Krajowego Rejestru Sądowego, pod numerem KRS: 0000791143, NIP: 5272896438, REGON: 38364670000000, (hereinafter “the Organiser”).
2. The prizes in the Contest are funded by Profesjonalna Liga Piłki Siatkowej S.A., ul. Bagno 2, 00-112 Warszawa, entered in the National Court Register kept by the District Court for the Capital City of Warsaw, 12th Business Division of the National Court Register under number KRS 0000151248 (hereinafter “PLPS”).
3. The Contest will be run through a website (hereinafter “the Website”) available at pls.wygrajsiatkarskalige.pl between 18 October 2019 and 20 May 2020.
4. The Contest will be organised on the territory of the Republic of Poland.
5. The Organiser hereby represents that the Contest is not a game of chance, lottery, mutual bet, promotional lottery or any other chance-dependent game for the purposes of the act on gambling of 19 November 2009.
6. The Organiser is solely responsible for the running of the Contest, the provision of the Website through which the Contest will be available, the determination of the Contest winners as well as the distribution of the prizes to the Contest winners.

II. Contest Participation
1. The Contest is available to individuals having full capacity to contract (hereinafter “Contestant”) subject to the next sentence. A minor over 13 years of age may participate in the Contest subject to a written consent to participation in the Contest from his/her parent or legal guardian, who will collect the prize on his/her behalf. In the event of a win, a minor Contestant must submit such consent to the Organiser. Failure to fulfil the above obligation will be deemed as waiver of participation in the Contest and of the right to any Prizes.
2. The players and employees of the PlusLiga clubs, the Organiser's and PZPS’s employees as well as their family members may participate in the Contest. However, they will not be eligible for the prizes and their taking prize-winning places will have no impact upon any other users' rights to claim prizes. Where a prize-winning place is taken by a person not eligible for the prizes, the prize for such place will be awarded to the person who has taken the next place.
3. The conditions precedent for the participation in the Contest are:
a. provision of the data required in the registration form: email address, which will be the Website account login, password and repeated password to the Website account,
b. provision, upon account (hereinafter “Account”) activation, of the name, surname and nickname of the user’s choice,
c. acknowledgment, at registration, that he/she has read the Contest Terms and Conditions and accepts the same.
4. Upon registration with the Contest, the Contestant may give voluntary consent to his/her personal data provided in the registration form being processed for the purposes of running the Contest and awarding of the Prizes. The provision such data is voluntary; however, it is necessary in order for a Contestant to participate in the Contest.  Such consent may be cancelled at any time and will result in the Contestant being excluded from the Contest.
5. While registering with the Contest a User may give his/her voluntary consent to the personal data provided in the registration form being processed by PLPS for the purpose of informing in the future of similar contests being organised by PLPS relating to PlusLiga games or other sport events. Such consent may be cancelled at any time.
6. A Contest Participant selects, on the terms set out below, a virtual team to score a maximum number of points throughout the PlusLiga league over the twenty six rounds in the 2018/2019 league and play-offs.
The play-offs will be organised as follows:
a) quarterfinal games, games for places 9-14, other games scheduled at the same time (for the purpose of round ordering in the contest, round no. 27);
b) semi-final games, games for places 5-8, other games scheduled at the same time (for the purpose of round ordering in the contest, round no. 28);
c) final games, games for places 3-4, other games scheduled at the same time (for the purpose of round ordering in the contest, round no. 29);
d) The rules for playoffs (rounds 27, 28 and 29) are laid down in Chapert VI of these Terms and Conditions.

III. Registering a Club
1. A Contestant may join the Contest either prior to the start of Round 1 of the PlusLiga 2019/2020 season or within the duration of the Contest as set out in section II. 6.
2. Contest may be joined by submitting a duly completed electronic form available on the Website containing:
a) the name of the Club (hereinafter “Club”), consisting of between 3 and 18 characters, to be visible in rankings to all Contestants, and the name of a club from the club list with which the user’s Club will be ranked in the so called Club League, and the name of the region (Voivodship) from the region list in which the user’s Club will be classified in the so called Regional League;
b) names and surnames of 12 volleyball players, selected from the transfer list, to make up the Club;
c) names and surnames of 7 players of the team (hereinafter “Team”) signed up for a given Games Round, on the terms set out in section IV of these Terms and Conditions;
d) name one of the players selected and signed up for a given Round as Club/Team captain and one as vice-captain.
3. In order to enable the Contestants to set up Clubs, the Organiser will publish a transfer list on the Website, i.e. a list of the volleyball players available to the Contestants together with the conventional value of each player.
4. Out of the transfer list, a Contestant “buys” 12 “real” players to make up his/her Club. The players’ “purchases” are made at “purchase prices”. The players’ prices will be set up by the Organiser. The prices may change (rise or fall) during the Contest, depending on the numbers of points scored. The changes will be adjusted by the Organiser.
5. The number of players of a single league club must not exceed two. Where, during the Contest, the Contestant’s Team contains more than two players of a single club, as a result of players changing clubs, the Contestant must carry out transfers accordingly, so as not to be in breach of this subsection.
6. A club’s budget on joining the Contest is PLN 27 million. The budget may change if the value of players held by the club’s president increases or decreases.
7. On registering a Club with the Contest, the Contestant “buys” two opposites, two setters, two liberos, three outside-spikers and three middle-blockers. These Terms and Conditions do not allow other combinations of players’ positions within a Club. The Organiser will determine, in the transfer list, which players are opposites, which are setters, which are liberos, which are outside-spikers and which – middle-blockers.
8. During the season, a Contestant may, within the deadlines set out on the Website, make changes to his/her Club by “selling” and “buying” players at their respective prices set out in the then current transfer list, within the available budget and subject to the limitation set out in subsection 5 above and the player distribution rule under subsection 7 above.  A Contestant may also change the Club/Team captain and vice-captain between league rounds.
9. The Organiser makes changes to the transfer list during the season. The Organiser will ensure an up-to-date transfer list for the Contestants to choose from in selecting their Clubs/Teams prior to each Round of the Games. Changes to the transfer list will be due to the introduction of new players.
10. Where, during the Contest, the Contestant’s Team becomes incomplete, as a result of players changing positions (e.g. from that of opposite to outside spiker), the Contestant must carry out transfers accordingly, so as to comply with all the rules of the Contest. In such situations, the Organiser will expressly inform Contestants, in reasonable time, of any changes in players’ positions so as to allow Contestants reasonable time to make relevant adjustments to their respective squads.
11. Upon the end of the Contest, the Organiser will automatically save the accounts and Club names set up during the Contest for the purposes of future Contest editions unless the Contestants decides otherwise.
12. A Contestant may set up a maximum of 5 clubs in the Contest, all only under one and the same login.

IV. Submitting Teams before Rounds
1. The Contest comprises twenty six rounds of the league games of the 2019/2020 season of the volleyball PlusLiga, starting with Round 1, plus play-offs referred to in section II.6.
2. Out of the 12 volleyball players “purchased” by themselves for the Club, Contestants select 7 players (hereinafter “the Team”) and sign up the Team to participate in a given Round of the Games.
3. Until the moment each time specified by the Organiser on the Website as deadline for a given Round, the Contestant may freely shape and change the composition of the Team signed up for a given Round as well as making transfers, i.e. “purchasing” and “selling” players of his/her Club or the signed-up team within the budget specified in section III. 6, subject to the limitation under subsection III.5. A Team must in every Round consist of: two outside-spikers, two middle-blockers, one setter, one opposite and one libero.
4. Where a Contestant has not made any modifications to his/her Team within the deadline specified for signing up a Team for a given Round, the Organiser will deem the Team to be signed up in the same line-up as that for the previous Round, subject to subsection III.5.

V. Scoring
1. The players “purchased” by Contestants correspond to the players actually playing in the PlusLiga Games, in their respective clubs and are awarded, or lose, points for their performance. The number of points scored by a Contestant is equal to the total scores won by the basic seven players selected to his/her Team, as well as the substitutes, subject to subsections V.2 and V.3.
2. The points for a Club in a given Round are only scored by the players signed up by the Contestant as Team members for a given Round of the league Games. Should a player, as signed up by a Contestant for a given Round, not actually play in a PlusLiga game, he will be substituted by a substitute playing in the same position.
3. In the event that e.g. two Team A middle-blockers of the Club do not play in a given Round, with the substitute middle-blocker playing, then only six players will score for the Club in that Round.
4. Points are only scored by the players who actually played in a given match, regardless of the length of presence on the court (unless otherwise provided by the respective scoring rules for a given position). A player will be deemed to have participated in a match where he appeared for a minimum of 1 action during the match.
5. A player, regardless of his position, will score points for:
a) Participation in a match – 2 points for Team A players and 1 point for substitutes, subject to subsubsection 5b below.
b) Libero always scores 1 point per participation in a match.
c) For the match score:
- for a 3:0 or 3:1 score – 3 points,
- for a 3:2 score – 2 points,
- for a 2:3 score – 1 point,
d) For a MATCH MVP – 3 points.
6. A player in the position of opposite will score:
a) 1 point per each point (apart from an ace or block) scored during a match;
b) 2 points per each point scored as an ace;
c) 2 points per each point scored as a block.
7. A player in the position of middle-blocker will score:
a) 1.5 point (1.5 conversion factor) per each point (apart from an ace or block) scored during the match. Where the number of points scored is odd, the result of conversion will be rounded up.
Example. For 3 normal points scored in a match. 3 times 1.5 equals 4.5. The number rounded up obtains 5 points for the scoring.
b) 2 points per each point scored as an ace;
c) 2 points per each point scored as a block.
8. A player in the position of setter will score:
a) 3 points per each point (apart from a block) scored during the match;
b) 3 points per each point scored as an ace;
c) 2 points per each point scored as a block.
d) score bonus for the Team A setter:
3:0 – 10 points,
3:1 – 7 points,
3:2 – 4 points,
2:3 – 1 point;
e) score bonus for the substitute setter. If the substitute setter starts at least one set in the starting lineup, he will receive a score bonus:
3:0 – 5 points,
3:1 – 3 points,
3:2 – 2 points,
9. A player in the position of outside-spiker will score:
a) 1 point per each point (apart from an ace or block) scored during a match;
b) 2 points per each point scored as an ace;
c) 2 points per each point scored as a block.
d) points for reception accuracy. A player must have a minimum of 11 reception in a match:
- 81% - 100% - 10 points.
- 66% - 80% - 8 points.
- 51% - 65% - 6 points.
- 36% - 50% - 4 points.
- 26% - 35% - 2 points.
e) points for reception accuracy. Total reception in a match - between 5 and 10 receptions:
- 81% - 100% - 5 points.
- 66% - 80% - 4 points.
- 51% - 65% - 3 points.
- 36% - 50% - 2 points.
- 26% - 35% - 1 points.
10. A player in the position of libero will score:
a) points for reception accuracy. A player must have a minimum of 11 reception in a match:
- 81% - 100% - 20 points.
- 66% - 80% - 16 points.
- 51% - 65% - 12 points.
- 36% - 50% - 8 points.
- 26% - 35% - 4 points.
b) points for reception accuracy. Total reception in a match - between 5 and 10 receptions:
- 81% - 100% - 10 points.
- 66% - 80% - 8 points.
- 51% - 65% - 6 points.
- 36% - 50% - 4 points.
- 26% - 35% - 2 points.
11. The points scored or lost by the player appointed by the Contestant as the Team captain for a given Round will be double those set out in subsections 5-10 above.
In the event that the Team/Club captain does not play in a league Round, his role is assumed by the vice-captain, whose scores are doubled accordingly. If neither the captain, nor the vice-captain, plays in a match, the points scored by the substitutes substituting them will not double.
12. After each round a Contestant may sell and buy players from and to his/her Team. The first two transfers (transfer is understood as replacement of one player of the Team for another from the transfer list) are free of charge, i.e. no points will be deducted from your next round score account. However, if a Contestant wishes to replace another player (i.e. third, fourth, etc.), 5 penalty points will be deducted per each transfer above the limit. This rule is not applicable before the first Round before which a Contestant joins the Contest.

13. During the Contest are available for managers additional activity (one time for a Round).
a) Two times during the Contest may use wild card. Wildcard - all transfers in the Round are free of charge. Wild card can be used for the first time in PlusLiga - league games, that is between 1 and 26. The second time - in the PLAY-OFF Rounds, that is 27, 28, 29.
b) Starting To attack! causes that points scored by two attackers (team A and substitute). Libero does not score. During the Contest of the Attack! can be used only once and only for the first time in PlusLiga - league games, that is between 1 and 26.
c) Starting Captains of Two causes that captain and vice-captain score twice. During the Contest Captains of Two can be used only once and only for the first time in PlusLiga - league games, that is between 1 and 26.. 
14. Points are awarded based on the statistics published by PLPS. The statistics are subject to verification and may be changed either during or after a given Round. For the purposes of the Contest, the scoring published on the Website is final, subject to the right to lodge a complaint.

VI. Play-offs (Rounds: 27, 28, 29).
1. In the 27st and 28nd Rounds the limit of players of a single league club is 3.
2. In the 29rd Round the limit of players of a single league club is 4.
3. In the 29rd Round a Club’s transfer budget is PLN 30 million.
4. The Organiser will decide which matches will be considered in a given Play-off Round.
5. The Organiser hereby informs that the Play-off (Rounds: 27, 28, 29) rules are subject to change. The Organiser will give reasonable and express notice of any changes to the Play-off rules.

VII. Standings
1. General Standings – covers all Teams registered with the Contest and shows the sum total of the points awarded in the Contest. The Contestant whose Club has won the greatest total number of points, awarded to its players during the PlusLiga Games, as set out in subsection II.6., will become the Contest Winner.
2. Round Standings – comprise the Teams signed up for a given Round and shows the points scored by the Teams in a given Round of the League. Round – breakdown of the matches corresponding in time to the actual PlusLiga round.
In the event of postponed matches, the set of pairs in a Contest Round may differ from that in the PlusLiga round.  Information of any changes will be expressly provided on the Website.
3. Monthly Standings – comprises the points scored by the teams in all rounds in a given month. A Round “belongs” to the month in which the first match of the Round started.
4. Private Leagues – each Contestant may set up or join a Private League. There are two types of Private League in the Contest: open and closed. An Open League may be joined by any Contestant. Access to a Closed League requires provision of a code generated by the League Administrator. The User creating a league will be such League’s Administrator. A team may join 10 other Private Leagues.
5. Private League Standings – the points of a league in the Private League Standings comprise the total scores of the fifteen best teams of the League.
6. Club Standings – comprise the Clubs selected by Contestants out of the14 PlusLiga clubs at registration.
7. Regional Standings – includes the Clubs selected by Contestants out of the16 regions (Voivodships) at registration.
8. Where two or more Contestants have achieved equal total scores, then the order of precedence is determined based on the greatest number of points in a Round out of all Rounds played. Where the total scores are still equal, then the order in the ranking is determined based on the Rule of Precedence, i.e. the time the Team was registered (the earlier time, the higher ranking). A Team is signed up once the system has accepted a duly completed form selecting 12 players, captain and vice-captain and the lineup has been saved.

VIII. Prizes
1. The Prizes in the Contest will be:
a)    For the Contest Winner, i.e. the Contestant whose Club has won the greatest total number of points in the Games, as set out in subsection II.6.: PLN 500;
b)    for the 2nd place: ball MIKASA;
c)    for the 3rd place: ball MIKASA;
2. The Prizes for league creators in the Private League Standings:
a)    for the 1st place: ball MIKASA;
3. The Prizes for winning the Monthly Standings (October, November, December, January, February, March and April):
a) for the 1st place: ball MIKASA;
4. PLAY-OFF Standings Prizes:
a)  for the 1st place: ball MIKASA;
5. PLS CUP Standings Prizes:
a)  for the 1st place: ball MIKASA;
6. The Prizes cannot be replaced.
7. The Prizes awarded in the Contest are taxable under the act on personal income tax of 26 July 1991 (consolidated text: Journal of Laws of 17 January 2012, item 361, hereinafter "Personal Income Tax Act"). The Organiser hereby informs that a lumpsum tax at a rate of 10% of the value of the Prize is due where the value of the Prize exceeds PLN 2000. The amount of tax deducted from the Prize will be remitted by the Organiser to the relevant Tax Office under Art. 30 (1)(2) of Personal Income Tax Act with the balance to be paid to the Winner.
8. It is the Sponsor’s obligation to calculate, collect and pay the tax to the bank account of the relevant Tax Office.
9. During the Contest, the Sponsor may offer additional prizes other than those set out in section VIII. The types of prizes and conditions of their award will be expressly stipulated on the Website. The offer of additional prizes will not be deemed as an amendment to these Terms and Conditions.

IX. Awarding of Prizes
1. The Organiser must verify the personal data of the Laureates and deliver to them the Prizes.
2. The Organiser will verify the Contest outcome and publish on the Website a list of Laureates containing the following data: name, surname and Club name, within 14 business days of the end of the Contest. Each Contestant consents, in the event of winning a Prize in the Contest, to his name and surname being published on the Website along with the information about the Prize.
3. Upon verification of the results in accordance with subsections 1 and 2 above, the Organiser will send an email, within 14 business days of publishing the List of Laureates, to the Contest Laureates requesting them to provide their details, i.e. name and surname, address, bank account number and telephone number for contact purposes.  The Contestant will be required to provide the above details, within 14 business days of receiving a relevant email, by email to the Organiser's email address from which the information on the win was sent.
4. The details of delivery of Prizes to the Laureates, including the manner, place and time of delivery, will be agreed upon with each Laureate, with the Prized being delivered no longer than within 30 calendar days of the date of informing the Laureate of the win.
5. The Contestant providing incorrect data or a change in such data precluding the Contestant to whom a Prize has been awarded from being contacted may result in such Contestant being excluded from the Contest. A Contestant must immediately inform the Organiser about any changes in his/her personal data, by e.g. sending an email to the address provided by the Organiser.
6. In the event of failure by a Contestant to provide the data set out in subsection 3 above within the specified deadlines, the Contestant will forfeit his/her right to the Prize.
7. A Laureate may not assign the right to the Prize to any third parties.

X. Data Processing
1. The Organiser acts as the administrator of the data provided by the Contestants.
2. The personal data are provided voluntarily; however, their provision is prerequisite to participation in the Contest. The Organiser will process the following personal data of the Contestants: name and surname, email address, telephone number on delivery of Prizes. The Contestants’ personal details will only be processed for the purposes of correctly running the Contest, including the delivery and settlement of Prizes and contact with the Contestants. A Contestant has a right to access and amend his/her personal data, and to request that such data no longer be processed.
3. Personal data may be amended or removed by a Contestant in the profile settings on the Website or by the Organiser at the Contestant’s request submitted to the address provided in section XII of these Terms and Conditions or to the email address provided by the Organiser. In the event of a request in writing, the Contestant must provide a mailing address.
4. A request must specify the exact data to be removed. The Contestant will be informed of the data being removed by email or mailing address provided by the Contestant.
5. The Contestants’ data processing term, for the Contest purposes, begins at the time the data are provided by the Contestants until the lapse of the deadline for lodging and handling the complaints by the Organiser as set out in these Terms and Conditions.

XII. Complaints Procedure
1. Each Contestant may lodge a complaint with the Organiser in connection with the Contest.
2. Complaints may be submitted in writing to the Organiser’s address: Gameweek sp. z o. o., ul. Grzybowska 30/1121, 00-863 Warszawa, providing a mailing address to which a response may be sent, or by email to: [email protected]
3. A complaint must contain: name, surname and mailing address of the person making a claim, as well as a detailed specification of the grounds for the complaint and the claim itself.
4. Complaints may be lodged throughout the duration of the Contest and not longer than within 14 business days of the date the List of Laureates is published. The deadline for lodging a complaint will be deemed to be observed based on the date on the postal stamp, date of dispatch of a messenger parcel containing the complaint or date of registration by the server of an email containing the complaint.
5. The Organiser has 7 business days of receipt of a complaint to process it. The Organiser will respond, as soon as the compliant has been handled, to the Contestant who lodged a complaint in writing by registered mail to the mailing address provided by the Contestant, and, additionally by email. Complaints made by email will be responded by email.
6. A Contestant whose complaint has not been admitted may enforce any claims by way of litigation before a relevant court of law.

XIII. Final Provisions
1. In the event of a match being rescheduled, repeated, cancelled, or in any other situations not provided for in these Terms and Conditions, the decision on how points are to be awarded and which standings will be affected will be made by the Organiser after the decision of the Tournament organiser.
a) The Contestant must comply with the rules for email address registration, Club registration and Team creation. In the event of inadmissible operations which may result in the limit on the number of players of a single club or the available budget being exceeded, the Contestant must sell a player and purchase another.  Failing that, the operations on the lineup will not count for the Round scoring, and points will be awarded as per the lineup for the preceding Round, subject to section III. 5.
b) The number of matches in a given Contest Round may differ from the actual set of pairs of the corresponding PlusLiga round. In such situations, the Organiser will expressly inform Contestants on the Website, with reasonable notice, of any changes to the matches “belonging" to a given Contest Round. In the event that in a single Round – in accordance with the pairing list published by the Organiser – one club plays to matches, then the players playing in those matches score points for both matches. In the event that in a single Round – in accordance with the pairing list published by the Organiser – a club plays no matches, then the players of the club do not score any points in the Round.
2. The Organiser hereby informs that any events that are not part of standard operation of the Contest which cause or may cause disruptions to the running of the Contest may affect its operation. In such cases, the Organiser will decide whether or not to continue with the Contest.
3. A Contestant may resign from the Contest by sending a resignation in writing to the Organiser’s address, as well as by email to the address: [email protected] A resignation by a Laureate entails a waiver of the right to the Prize awarded.
4. The Organiser has the right to amend these Terms and Conditions in the event that, e.g., it is necessary to provide for changes in the law, make precise any provisions arising doubts of Contestants or in order to better protect Contestants, insofar as it will not adversely affect the terms of participation in the Contest or the basic rules of the Contest. Any amendments to these Terms and Conditions will not affect any rights already acquired by the Contestants. The information on any amendments to these Terms and Conditions will be published on the Website and sent by email to all Contestants who joined the Contest prior to such amendments and agreed to their data being processed.
5. Contestants will be notified of any amendments to these Terms and Conditions in advance so as to enable them to familiarise themselves with such amendments and, if applicable, to withdraw from the Contest. Should a Contestant not accept any of the amendments to these Terms and Conditions, he/she may withdraw from the Contest without any adverse consequences.
6. In matters not regulated herein, the relevant provisions of the law will apply.
7. These Terms and Conditions are in force from 18 October 2019 until the expiry of the period set out in these Terms and Conditions for lodging complaints and complaint handling by the Organiser.
8. These Terms and Conditions do not affect the rights of the Contestants as Consumers under the applicable regulations, which take precedence over these Terms and Regulations.
